Offer of Settlement Issued
Charles A. West, manager of Charles A. West Funeral & Cremation Service LLC, signed an Offer of Settlement in Lieu of Formal Disciplinary Action and paid a penalty of $2,500 for failure to maintain a full and accurate record of funeral services provided, in violation of N.J.A.C. 13:36-1.8(a) and (c). As part of the agreement, West is required to complete three continuing education hours in Ethics and New Jersey Funeral Law within six months of the agreement.
In the Offer, the Board determined that full and accurate records were not maintained in connection with a Work First NJ/Medicaid funeral. In its review, the Board identified several discrepancies and omissions, including that the family contribution exceeded the allowable amount for Medicaid funerals; funds received by the funeral home for the cemetery and church were not listed as cash disbursements; and that the funeral charges on the Form PA-11 were inconsistent with the total on the Statement of Funeral Goods and Services Selected.
Final Order of Discipline Issued
A Final Order of Discipline was issued against Donald W. Woodside on June 7, 2021, suspending his license for “failure to timely complete required continuing education, failure to maintain documentation of completion as required by Board regulations, and failure to submit said documentation to the Board upon request. Additionally, Mr. Woodside paid a $1,000 penalty for failure to cooperate with the Board and another $500 for failing to complete the required continuing education.
Continuing Education Report
The Board approved the courses listed on the meeting agenda, with several exceptions.
